Understanding Immigration Mental Health Evaluations

What is an Immigration Evaluation?

As your lawyer has likely explained, an immigration evaluation is a specialized psychosocial assessment designed to provide evidence for your immigration case. It goes beyond a standard mental health assessment by exploring the intricate connection between your mental well-being and your life experiences within the context of your immigration journey.

A “psychosocial” evaluation considers both your mental health symptoms and the various social factors impacting you. We understand that your current emotional state is influenced by many things, including your family history, socioeconomic background, past trauma, medical conditions, and the support systems available to you. Our evaluations aim to comprehensively understand how these factors have shaped your current emotional state and how they relate to the specific challenges of your immigration case. This detailed understanding provides vital information for your legal application.

Types of Cases We Support

Our experienced clinicians provide specialized mental health evaluations to support a variety of immigration and asylum cases. Here’s a more detailed look at how our evaluations can assist in each of these areas:

These waivers are often required when an immigrant relative of a U.S. citizen or lawful permanent resident has a ground of inadmissibility that would prevent them from obtaining a green card or entering the U.S. Our evaluations assess the extreme hardship that the U.S. citizen or lawful permanent resident relative would experience if their loved one were denied entry or deported. This hardship can include significant emotional, psychological, financial, and medical challenges. Our evaluations thoroughly document the psychological impact of this potential separation or denial.

The Violence Against Women Act provides protections for immigrant survivors of domestic violence, including spouses, parents, and children of U.S. citizens or lawful permanent residents who have been abused. Our evaluations in these cases focus on assessing the psychological trauma and emotional distress resulting from the abuse. We document the history of abuse, its impact on the survivor’s mental health, and any resulting conditions such as PTSD, anxiety, or depression. This evidence can be crucial in supporting their VAWA self-petition.

Individuals facing deportation (removal) may be eligible for Cancellation of Removal if they can demonstrate that their deportation would cause exceptional and extremely unusual hardship to certain qualifying relatives who are U.S. citizens or lawful permanent residents (typically a spouse, parent, or child). Our evaluations assess the psychological impact that the deportation of the applicant would have on these qualifying relatives, detailing the potential for severe emotional distress, mental health deterioration, and other significant hardships.

The U-Visa is for victims of certain qualifying crimes who have suffered substantial physical or mental abuse and have been helpful to law enforcement in the investigation or prosecution of that crime. Our evaluations for U-Visa applicants focus on documenting the significant mental health consequences resulting from the criminal victimization. This includes assessing trauma, PTSD, anxiety, depression, and other psychological effects of the crime, providing crucial evidence of the harm suffered.

The T-Visa provides immigration status to victims of severe forms of human trafficking. Our evaluations for T-Visa applicants focus on assessing the severe psychological trauma experienced as a result of being trafficked. We document the history of exploitation, the resulting mental health conditions, and the ongoing impact of this trauma on the individual’s well-being and functioning.

Individuals seeking asylum are often fleeing persecution or have a well-founded fear of future persecution based on factors such as race, religion, nationality, membership in a particular social group, or political opinion. Our evaluations in asylum cases focus on documenting the psychological impact of past persecution and the ongoing fear of future harm. This can include assessing for PTSD, anxiety disorders, depression, and other mental health conditions resulting from traumatic experiences and ongoing stress.

The N-648 form is used by applicants for U.S. citizenship who are seeking an exception to the English and/or civics requirements due to a physical or mental disability. Our evaluations for N-648 cases involve a thorough assessment of the applicant’s medical condition and its impact on their ability to learn and demonstrate knowledge of English and/or civics. We provide a professional opinion on the existence and severity of the disability and its connection to the applicant’s learning capacity.

If your case falls into any of these categories, or if your legal counsel believes a mental health evaluation would strengthen your case, please do not hesitate to reach out to us. We are here to provide the specialized support you need.

Cost & Financial Assistance

The standard fee for a comprehensive immigration mental health evaluation at For All Counseling is $1,000. This fee reflects the expertise and time of our qualified and specialized therapists who conduct thorough assessments and prepare detailed, legally sound reports. We are committed to ensuring our therapists are compensated fairly for their crucial work in providing this expert service, which is vital to the outcomes of our clients’ immigration and asylum cases.

Sliding Fee Scale

We understand that the cost of an immigration evaluation can be a significant barrier for many individuals. In line with our mission to increase access to Mental Health Care, we offer a sliding scale fee program for those experiencing financial hardship. This program allows eligible clients to receive a reduced fee for their evaluation based on federal poverty guidelines.

Pay What You Can

If you are experiencing substantial financial hardship beyond what our Sliding Fee Scale can accommodate, we encourage you to contact us directly. Our “Pay What You Can” model allows you to prioritize your mental well-being by contributing an amount for your evaluation that is truly feasible for your financial situation.

Both our Sliding Scale and Pay What You Can programs are a testament to our commitment to ensuring that everyone has the opportunity to have their mental health needs considered in their immigration proceedings, regardless of their financial circumstances. To inquire if you qualify for either of these programs and to discuss your financial needs, please contact our office directly at (402) 442-0806. We are dedicated to working with you with compassion and understanding to find a solution that allows you to access the evaluation you need.

Requirement for Legal Consultation

To ensure your mental health evaluation is relevant and effectively supports your legal case, For All Counseling now requires all clients seeking evaluations for immigration or asylum matters to demonstrate that they have received a legal consultation from a qualified professional (private attorney, public defender, legal aid organization, or free legal clinic) prior to their evaluation with us. We strongly encourage you to consult with a lawyer as early as possible in your immigration or asylum process. Mental health evaluations may need updates after 12 months, and having legal counsel established can ensure proper timing and strategy.
